terms & conditions for drop, Vienna
1. General Terms
- These Terms and Conditions apply to all bookings made with Drop located in Gentzgasse 3, Top 1, 1180, Vienna.
- By booking and using our facilities, you agree to abide by these terms.
2. Booking and Payment
- All bookings must be made in advance through our website.
- Full payment is required at the time of booking unless otherwise agreed.
- Payment methods include credit card, bank transfer, or the alternative payment methods that are provided in Drop's official website.
- The minimum duration of a booking is 1 (one) hour.
- Prices are subject to change without prior notice. Any changes will not affect confirmed bookings.
- Booking confirmation is sent via email.
- If a band, an individual musician or the guests stay 15 minutes longer than the booked time, the additional time will be considered as 1 hour booking and fully charged directly on premises or via invoice due to be paid.
3. Cancellation and Refund Policy
- Cancellations made more than 48 hours prior to the booking will receive a full refund.
- Cancellations made between 24-48 hours prior to the booking will receive a 50% refund.
- Cancellations made less than 24 hours before the scheduled session will not be eligible for a refund.
- In the event of a no-show, no refund will be issued.
- If the studio must cancel a booking for any reason, a full refund will be provided.
4. Use of Studio Facilities
- The studio is available for rehearsals, practice, and related activities. Any other use must be approved in writing.
- The rehearsal room can only be used during the agreed period. Failure to vacate on time will result in additional charges as explained in section 2.
- The renter does not have an automatic right to extend the usage period.
- Extensions are possible if the operator agrees, but they are under no obligation to grant the extension.
- The maximum number of people allowed in the studio at one time is eight. Overcrowding is prohibited.
- Rooms and common areas have to be left as found, all the rubbish and waste should be taken out by yourself when leaving the premises. If not, additional cleaning fees will be charged directly.
- You are responsible for any damage to the studio, equipment, or facilities during your booking. Damages must be reported immediately and may incur repair or replacement charges (further conditions to be found in Section 5 “Equipment Damage & Theft”).
- Illegal activities during the use of our premises and equipment are not permitted. Drop accepts no responsibility.
5. Equipment Damage & Theft
- You are responsible for the proper use of all studio equipment during your session. Any damage caused by misuse or negligence will result in repair or replacement costs being charged to the person or group responsible.
- The studio reserves the right to inspect all equipment before and after each session to assess any damages.
- Theft of any equipment or property from the studio will result in immediate legal action, a permanent ban from the studio, and full financial liability for the stolen items.
- Every customer is required to test the equipment before use and to inform drop immediately in the event of damage.
6. Safety Measures
- All users of the studio are expected to follow health and safety regulations.
- Keep walkways clear of cables and equipment to avoid tripping hazards.
- In case of emergency, please follow the marked evacuation routes and use the fire exits.
- First aid kits are available in the studio. In case of injury, please notify studio staff immediately.
- Use equipment responsibly. Misuse of equipment may result in the immediate termination of your session without a refund.
7. No Smoking, Alcohol, and Drug Policy
- Smoking is strictly prohibited inside the studio and in any areas not designated for smoking.
- Alcohol and illegal substances are not permitted in the studio at any time.
- Any person found under the influence of drugs or alcohol will be asked to leave, and the session will be terminated with no refund.
- Violation of this policy may result in a permanent ban from the studio.
8. Noise Levels
- Please be mindful of the noise levels both inside and outside the studio, especially when other sessions are taking place.
- Rehearsal volume should be kept at a reasonable level to avoid disturbing neighboring businesses or residents.
- Excessive noise that violates local ordinances or causes complaints may result in session termination without a refund.
9. Security and Surveillance
- For security purposes (in particular protection against burglary and theft), the entrance area and all of the studios are video-monitored.
- By using the studio, all customers consent to being recorded while on the premises.
- Footage is recorded and stored in compliance with local privacy laws and will only be used for security, safety, and law enforcement purposes.
- The studio ensures that video recordings are kept confidential and will not be shared publicly unless required by law.
10. Liability
- Drop is not liable for any personal injury, loss, or damage to personal property while on the premises.
- Users are responsible for their own equipment and belongings.
- All users agree to use the studio at their own risk.
11. Studio Access
- Access to the studio is limited to the time slot booked. Please arrive and leave on time to ensure smooth operations for other bookings.
- Any overtime usage of the studio will incur additional charges, subject to availability.
- The studio reserves the right to refuse entry or remove any individual who violates these terms.
- We use an automated access system to fulfill usage agreements. An access code is provided with your booking which is valid for the time booked.
- If additional people are taken along, the booking musician also assumes liability for the additional guests. Staff must also be informed of any additional guests.
12. Privacy and Data
- We respect your privacy and are committed to protecting your personal information. All data collected during the booking process will be kept confidential and used solely for the purposes of managing your booking and communicating with you.
- Drop and third parties process the customer's personal data for a specific purpose and in accordance with the statutory provisions.
- The data provided (such as IP address,name, e-mail address, telephone number, address, payment data) for the purpose are used by drop to fulfill and process the booking. This data is treated confidentially by drop and by the third parties.
- The customer has the right, upon request and free of charge, to receive information about the data stored. In addition, customers have the right to correct incorrect data, block and delete their personal data, provided that there is no legal obligation to retain such data.
- Further information on the type, scope, location and purpose of the collection, processing and use of the required data can be found in drop's privacy policy.
13. Keeping Animals
- Animals can only be brought into the rehearsal room with prior approval from the operator.
- Animals have to be properly supervised during the stay, either personally or by a third party at their own expense.
- The person bringing an animal must have adequate liability insurance covering potential damages caused by the animal, and proof of insurance must be provided upon request.
- The owner and their insurance are jointly liable for any damage caused by the animal, including compensation that may need to be paid to third parties.
14. Amendments
- Drop reserves the right to amend these terms and conditions at any time. Any changes will be communicated via our website or email.
15. Place of jurisdiction, applicable law and contract language
- This contract shall be governed by Austrian substantive law to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If the contractual partner is a consumer, the mandatory provisions of the law of the country in which he has his habitual residence shall also apply to this contract.
- The court with subject-matter jurisdiction for the seller shall have exclusive jurisdiction for disputes. If the customer is a consumer within the meaning of the Austrian Consumer Protection Act (KSchG), the court in whose district the customer's domicile, habitual residence or place of employment is located shall have jurisdiction.
- The place of jurisdiction and place of performance of the contract is the registered office of Drop (Kerem Uzgören - Vienna).
- The contract language is English.
